O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order in T.R.2025/0103/25/141840TR dated 29.09.2025 passed by the second respondent, to quash the same and consequently to direct the respondents to issue a separate patta for the land measuring an extent of 161⁄2 cents comprised in Survey Nos.528/9A1 and 529/2A1 situated at Anumanthanpatti Village, Uthamapalayam Taluk, Theni District, based on Application No.2025/0103/25/141840, within the time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that by the impugned order, the second respondent has included the name of the Page No. 2 of 5

petitioner in the joint patta, but rejected the petitioner's request for issuance of a separate patta, purportedly based on the report of the Village Administrative Officer, which was neither furnished to the petitioner nor subjected to any enquiry or field inspection.

The learned Government Advocate appearing for the respondents, on instructions, would submit that if the petitioner applies for issuance of a separate patta in his name, the same will be considered on merits and in accordance with law after remitting the requisite fee, to which the learned counsel for the petitioner accedes.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with liberty to the petitioner to file a fresh application for issuance of a separate patta along with the requisite fee, in accordance with law. In the event of the petitioner filing such application along with the requisite fee, the same shall be considered and appropriate orders shall be passed by the second respondent on merits and in accordance with law, within a period of sixteen weeks from the date of receipt of such application. It is needless to state that the application shall be disposed of after conducting an enquiry Page No. 3 of 5

and that the second respondent shall provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing orders. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
