ORDER
The prayer in this writ petition is for a Writ of Mandamus, directing the respondents to issue the patta in petitioner's name by sub division in respect of the properties situates in Madurai District, Madurai North now Madurai East Taluk, Vandiyur 2nd Bit Village in Survey No.260/1B, bearing Plot Nos.16 and 20 based on his application dated 26.12.2016 within the time stipulated by this Court.
2.Heard Mr.S.M.Mohan Gandhi, learned counsel appearing for the petitioner and Mr.C.M.Mari Chelliah Prabhu, learned Additional Government Pleader appearing for the respondent. 3.The petitioner, in order to get patta after sub division of the land situated in S.No.260/1B, at Vandiyur 2nd Bit Village,
Madurai North now Madurai East Taluk, Madurai District, had approached the respondents, especially, the 2nd respondent Tahsildar and in this regard, he has given representation/application on 26.12.2016 and 13.05.2019. Having receipt of the application as well as the representation from the petitioner, the respondents, especially, the 2nd respondent has not acted upon in subdividing the property and give the patta for the land belongs to the petitioner. Therefore, the petitioner is before this Court. 4.I have heard the leaned Additional Government Pleader appearing for the respondents, who would submit that, based on the application submitted by the petitioner as well as the representation given by him dated 13.05.2019, the same would be considered and necessary orders would be passed after completing the said sub division work by the 2nd respondent office, within a time stipulated by this Court.
5.Considering the limited scope of the prayer sought for in this writ petition, this Court is inclined to dispose of this writ petition with the following direction:
"The 2nd respondent is directed to act upon as per the application of the petitioner dated 26.12.2016 and consider his representation dated 13.05.2019 with regard to grievance of sub division of his land and to issue patta and pass orders thereon, after taking necessary steps in this regard, within a period of eight weeks from the date of receipt of a copy of this order." 6.With the above direction, this petition is disposed of. No costs.
