ORDER

Heard both sides.

2. The respondents have raised the impugned demand on the petitioner on the basis of an audit slip. Copy of the audit slip was not furnished to the petitioner. No notice has been given to the petitioner before raising the impugned demand. More than anything else, the details are completely absent. The petitioner does not even know as to why the impugned demand is being made on him.

3. In view of the clear violation of principles of natural justice, the impugned order is quashed. The matter is remitted to the file of the second respondent. The second respondent is at liberty to issue fresh notice to the petitioner. Notice will contain all the relevant details. The basis of the demand must be made known to the petitioner. The petitioner's objection will be received. If necessary, summary enquiry 2/4

may be held. Thereafter, final order shall be passed. The learned counsel appearing for the petitioner is directed to furnish copy of the address for service to the learned Standing Counsel appearing for TANGEDCO. Fresh notice now directed to be issued will be sent to that address. I make it clear that I have not gone into the merits of the matter. All the defenses of the petitioner are left open. This writ petition is allowed accordingly. No costs. Consequently, connected miscellaneous petitions are closed.

4.At this stage, the learned counsel appearing for the petitioner states that since the petitioner did not comply with the impugned demand, the service connection was cut off. Since the demand itself has now been set aside and the issue has been remitted to the file of the second respondent, without seeking any re-connection charges, the respondents shall restore the supply of electricity immediately and without any delay.
