Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 302 @ 302 r/w. 109 of IPC in Crime No.538 of 2015, seek anticipatory bail.

2. The case of the prosecution is that on 28.10.2015, on information the defacto complainant went to the house of one Ravichandran and found him that with stab injury. On his complaint, a case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) submitted that on investigation it was found that A1 is the wife of the deceased, due to the illicit intimacy with the wife of the deceased, both the petitioner and A1 committed murder of the deceased. He further submitted that A1 arrested only on 29.05.2016 and enlarged on bail and the investigation of the case is pending. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the serious nature of serious allegations levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
