For Respondent : Mr.E.Antony Sahaya Prabahar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.58 of 2019 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8 (c) r/w 20(b)(ii)(C) and 25, 27(A), 29(1) of NDPS Act, in Crime No.58 of 2019, seeks anticipatory bail.

2.The case of the prosecution is that based on the secret information received, the respondent Police conducted raid and they seized Ganja weighing 80kgs from the accused persons. Hence, the present complaint.

3.The learned counsel for the petitioner would submit that after investigation, the respondent Police filed the charge sheet against 11 persons before the Additional District and Sessions https://hcservices.ecourts.gov.in/hcservices/

Judge/Special Judge for NDPS Act, Pudukottai and the same was taken on file in C.C.No.38 of 2022.

4.The learned Additional Public Prosecutor appearing for the State would submit that the absconding charge sheet has been filed as against the present petitioner and that the learned Magistrate after taking the case on file, ordered for issuance of summons to the petitioner.

5.Since the concerned Court has already issued summons for appearance of the petitioner, the question of granting anticipatory bail does not arise at all. Hence, the Criminal Original Petition is dismissed.
