For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.63 of 2020 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.

2.The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 341, 294(b), 323, 324, 506(ii) and 379 of I.P.C., in Crime No.63 of 2020 on the file of the respondent police, seek anticipatory bail.

CRL OP(MD) No.4342 of 2020 3.Due to quarrel regarding parking two wheeler in the middle of the road, a problem was created in which, the petitioners and others armed with iron rod, has attacked the defacto complainant and yet another person by name Parthipan. Both have sustained injuries. Therefore, a case has been registered for the offence under Sections 147, 148, 341, 294(b), 323, 324, 506(ii) and 379 of I.P.C., against 10 persons. These petitioners are arrayed as A3 and A4. 4.The learned counsel for the petitioners would submit that A7 to A10 have already been granted bail and anticipatory bail may be considered on simpathy ground.

5.The learned Government Advocate(Crl.side) would submit that these petitioners have overt act in assaulting the defacto complainant and Parthiban and therefore they cannot seek anticipatory bail. Further more, the learned Government Advocate (Crl.side) would submit that both the petitioners had bad antecedents.

6.In view of the same, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
