When the matter came up for hearing on 16.06.2021, there was no representation for the petitioner. Therefore, the Criminal Original Petition was listed under the caption 'for dismissal today (30.06.2021).
2. Today, when the matter is taken up for hearing, the learned counsel for the petitioner, appearing through Video Conference mode, made his submissions.
3. The learned Additional Public Prosecutor (Crl. side) would submit that based upon the complaint given by the petitioner herein, enquiry was undertaken in C.S.R.No.246/2020 and during the course of https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD) No.3987 of 2021 enquiry, the fact that the offended Whatsapp message was not sent by the respondent, which fact was also admitted by the petitioner and on that ground, further enquiry was stalled. The statement given by one Yasmin Fathima is also enclosed.
4. Since the enquiry itself is closed, nothing survives for further consideration. Recording the same, the Criminal Original Petition is disposed of.
