ORDER
This criminal original petition has been filed for quashing the impugned proceedings in C.C.No.54 of 2018 on the file of the Judicial Magistrate No.2, Sivagangai.
2.The petitioner is facing trial for the offences under Sections 279 and 304(A) of IPC.
3.Though the petitioner's counsel contentions are quite attractive, I am of the view that considering the factual nature, they will have to be established only before the Court below. Therefore, without going into the merits of the matter, this criminal original petition stands dismissed. All the contentions and defences of the petitioner are left open.
4. However, the Court below will insist on the personal appearance of the petitioner only on three occasions namely, to answer the charge, for examination under Section 313 of Cr.P.C., and at the time of pronouncing Judgment. On all other occasions, the petitioner need not appear in person before the Court below. However, on those occasions, the petitioner will have to be represented by his counsel. If the petitioner's counsel is also absent, the benefit of dispensing with the personal appearance of the petitioner will stand automatically vacated.
