ORDER
This Criminal Original Petition has been filed to direct the Special Court for Exclusive Trial of cases under SC/ST Act Cases (PCR Court), Thoothukudi, to accept the surrender of the petitioner/A1 in connection with the case in Crime No.66 of 2026 on the file of the second respondent Police and to consider his bail application on the very same day of surrender.
2.Since there is no adverse order passed against the 3rd respondent, notice to the 3rd respondent is dispensed with. 3.The case of the prosecution is that the third respondent/defacto complainant is a painter and has three daughters and he is residing in 2/5
his elder daughter's house. On 17.01.2026, the petitioner and the other accused persons allegedly attacked the son-in-law of the defacto complainant. When the same was questioned by the defacto complainant, the petitioner and the other accused persons abused him by mentioning his caste name and also assaulted him with their hands. Based on these allegations, an FIR has been registered against the petitioner.
4.Heard the learned counsel on either side and carefully perused the materials available on record.
5.Considering the limited scope of the relief sought for, this Court hereby directs the Special Court for Exclusive Trial of cases under SC/ST Act Cases (PCR Court), Thoothukudi, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.66 of 2026 on the file of the 2nd respondent police.
