ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent herein to expedite the pending revision in Na.Ka.No.B10/15805/2022 preferred with respect to the land in Survey No. 361/1 to an extent of 1.05 Acres, situated at Notchivadi Village, Pamban Group, Rameswaram Taluk, Ramanathapuram District, within a time to be stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

4. The learned counsel for the petitioner submits that the petitioner is the absolute owner of the subject property and is in peaceful possession and enjoyment thereof. While so, one Malathi, who is the wife of the third respondent, claiming right over the property, filed a civil suit in O.S.No.3 of 2019 before the

Sub Court, Ramanathapuram, for partition and separate possession of the said property. The said suit was decreed against the petitioner's vendor, namely Ramanathan. Aggrieved by the same, the said Ramanathan filed an appeal in A.S.No.27 of 2017 before the Principal District and Sessions Court, Ramanathapuram. The first Appellate Court allowed the appeal and set aside the judgment and decree of the trial Court. Challenging the judgment and decree of the first Appellate Court, a Second Appeal in S.A.(MD)No.38 of 2019 has been filed and is pending before this Court, without any interim order. While so, the third respondent preferred an appeal before the second respondent, who, by proceedings dated 09.02.2022, mutated the Patta in his favour, which is illegal, arbitrary, and without jurisdiction. Hence, the petitioner preferred a revision before the first respondent, and the same is still pending. Since the said revision has not been considered so far, the petitioner has filed the present Writ Petition.

5. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the petitioner's revision will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's revision, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the third respondent and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order.
