This Writ Petition has been filed to direct the 2nd Respondent to consider the petitioner's representation dated 03.11.2025 and pass final orders for the issuance of Patta in favor of the petitioner's family members based on the order of the 3rd Respondent in Mu.Pa.A3/8856/2022 dated 29.05.2025 within a time. frame as fixed by this Court.
2. The learned counsel for the petitioner submitted that the petitioner's great-grandfather, Asher Nadar, was the original owner of the land in Survey No. 2/6
191/8, measuring an extent of 9 cents. After his demise, his four sons became entitled to the property through sale deeds. Subsequently, the petitioner's grandfather enjoyed the property and remained in continuous possession for more than 65 years until his death. Thereafter, the property was inherited by the petitioner's father and his uncle, Gnanadurai. Thus, the petitioner's family alone is entitled to the property. However, an error occurred during the UDR scheme, and the petitioner has applied for rectification of the said mistake.
3. Heard the learned Special Government Pleader appearing for the respondents 1 to 4.
4. Considering the facts and circumstances of the case, and in light of the direction issued by the second respondent to the third respondent to conduct an enquiry and submit a report. It is noted that the third respondent has completed the enquiry and passed an order dated 29.05.2025 in proceedings Pa.Mu.A3/8856/2022. In the said order, it was recommended that the petitioner's family members are entitled to the property and that any errors ought to be rectified. Accordingly, the second respondent is directed to consider the 3/6
petitioner's application dated 03.11.2025, taking into account the report submitted by the third respondent, and to pass appropriate orders within a period of four months from the date of receipt of a copy of this order.
