PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified mandamus calling for the records relating to the impugned order passed by the first respondent vide proceedings in NO.RO/TRY/403/2025-CA dated 08.01.2026 and quash the same as illegal and consequently direct the first respondent to grant 28 days ordinary leave without

police escort to the petitioner's husband namely Narayanan, S/o.Muniyan, aged about 65 years, Life Convict Prisoner PID No.135331 confined at Central Prison, Trichy.

O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO/TRY/403/2025-CA dated 08.01.2026 and direct the first respondent to grant 28 days ordinary leave without police escort to the petitioner's husband namely Narayanan, S/o.Muniyan, aged about 65 years, Life Convict Prisoner PID No.135331 confined at Central Prison, Trichy.

The petitioner's husband was convicted by the learned Sessions Judge, Fast Track Mahila Court, Thanjavur in Spl.S.C.No.18 of 2016 for the offences under Sections 3(a) r/w.5(m) r/w.6 of POCSO Act and sentenced to undergo life imprisonment. Aggrieved over the same the convict has preferred an appeal before this Court in Crl.A(MD) No.255 of 2019 and the same was dismissed on 10.08.2022. While being so, the petitioner being wife of the convict has

submitted representation seeking 28 days ordinary leave on the ground to complete the construction work of their house and to make some financial arrangement, however it was rejected on the ground that the Probation Officer has submitted adverse remarks and did not support the case of the petitioner. `3. A perusal of the record and the submission of the learned Additional Public Prosecutor reveals that the victims are residing just opposite to the house of the convict and there are five victims. Further the convict was convicted for the offences under Sections 3(a) r/w.5(m) r/w.6 of POCSO Act and sentenced to undergo life imprisonment and the Probation Officer has also no recommended the case of the petitioner for any leave, hence this Court finds no infirmity or illegality in the order passed by the first respondent.

4. Hence the petition stands dismissed.
