PRAYER : Writ petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the impugned proceedings issued by the first respondent in show cause No.TN 57 /2020/6 dated 30.01.2020 and to quash the same and consequently, direct the first respondent to return the petitioner's original Driving License bearing No.TN - 57-1999-0000766 forth with to the petitioner within a stipulated time that may be fixed by this Hon'ble Court. ORDER
Heard the learned counsel on either side.
2.The petitioner challenges the impugned order dated 30.01.2020, whereby his driving license has been suspended. 3.It appears that the petitioner was involved in an accident and a case under Section 304 (A) of IPC was also registered. Even though in the impugned order it has been mentioned that the show cause notice was issued, the petitioner has not submitted his explanation, the stand taken in the affidavit is that no show cause notice was received.
4.Be that as it may, I have not gone into the merits of the order. As rightly pointed out by the learned Government Advocate, https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD).No.4972 of 2020 the period in the impugned order has worked itself out. 5.The learned Government Advocate states that the period has already expired and the license will be returned to the petitioner after the petitioner attends a class and does a test driving. 6.Recording the said submission, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed .
