Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records on the file of the 1st and 2nd respondent pertaining to the impugned proceedings passed by them vide the proceedings of 2nd respondent, in Na.Ka.Aa2/3429/2018, dated 05.02.2021 and the consequential suspension order passed by the 1st respondent vide his proceedings in Se.Mu.No.Tha.1/2580/2021 and quash the same as illegal and consequently, directing the respondents to reinstate the petitioner to service with all monetary benefits within the time that may be stipulated by this Court.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents. 2.The petitioner has been placed under suspension on the allegations that he has misappropriated a sum of Rs.3,000/-, which has been collected by way of rent for the community hall belonging to the respondent panchayat.

3.Though the petitioner herein has challenging the suspension order, the learned counsel for the petitioner states that if the first respondent herein is directed to consider the petitioner's representation dated 17.02.2021, wherein he has sought for revocation of the impugned suspension order, he would be satisfied. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.5837 of 2021 4.In the light of the submissions made by the learned counsel for the petitioner, no interference is required to the impugned suspension order. However, there shall be a direction to the first respondent herein to consider the petitioner's representation, dated 17.02.2021, on its own merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
