JUDGMENT

2.The appellant is a self financing teachers training institute. They challenged the direction dated 28.09.2020 issued by the second respondent herein whereby, the appellant was restrained from admitting any student for the academic year 2020 - 2021. It is not in dispute that G.O.(Ms)No.87 School Education Department dated 28.05.2019 issued by the School Education Department was held inapplicable to self financing institutions by one of us (Mr.Justice G.R.Swaminathan) vide order dated 27.06.2022 in W.P.(MD)Nos.13478 of 2020 and 9817 of 2022. Another learned Judge of this Court also held that the aforesaid government order will not apply to aided institutions also and quashed the government order itself. itself has been quashed, any direction issued under the said government order cannot survive.

3.In this view of the matter, the order of the learned Single Judge is set aside. It is also submitted by the learned counsel for the appellant that pursuant to the interim order granted by this bench, the admission of the students had also been approved, results have also been declared and their certificates have also been issued. In a real sense, nothing survives for further adjudication in this writ appeal. Since certain adverse consequence will ensue for the appellant, we deem it fit to set aside the order passed by the learned Single Judge.
