This Contempt petition is filed that the order of this Court in W.P(MD) No.22341 of 2021, dated 16.12.2021 has not been complied with.
2.Today(05.08.2022), when the matter is taken up for hearing, the learned Additional Advocate General appearing for the respondent submits that the Government clarified that the undertaking given by the Government in earlier round of litigation in a batch of Writ petitions in W.P(MD) Nos.22338 of 2021 etc.,dated 16.12.2021 is only for those persons, who have availed the interim orders in the above writ petitions and it is not meant for others. The learned Additional Advocate General further submits that the petitioner herein has not filed any such writ petition earlier and he also participated in the counselling and opted a place nearby. Now the petitioner is working in Government Higher Secondary School, Natham Taluk, Periyurpatti, Dindigul, which is nearby to his earlier place of work. The learned Additional Advocate General expressed 2/5
that the respondents have also tried to accommodate the petitioner in any other nearby place. However, since there is no vacancy available as such, they could not do so. The learned Additional Advocate General has also produced the written instructions in Na.Ka.No. 59974/C2/E1/2021, dated 04.08.2022.
3.This Court considered the submissions made by the learned Additional Advocate General and also perused the materials placed on record.
4.It is an admitted fact that the petitioner has already participated in the counselling pursuant to G.O.Ms.No.176 dated 17.12.2021. It is also stated in the written instructions, dated 04.08.2022 that the petitioner, who was previously working in Block Resource Centre, Nilakkottai as Block Resource Teacher Educator is now working at Government Higher Secondary School, Natham Taluk, Periyurpatti, Dindigul, which is nearby from the earlier place of work. Considering the submission made by the learned Additional 3/5
Advocate General that though the respondent tried to accommodate the petitioner in any other nearby place, there is no vacancy, this Court is not inclined to pass any further order in this contempt petition.
