PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 05.02.2025 and take necessary appropriation action against the Respondents 4 to 7. O R D E R
This Writ Petition has been filed seeking a direction to the respondent police to consider the petitioner's representation dated 05.02.2025 and take necessary appropriation action against the Respondents 4 to 7.
2.According to the petitioner, she faced dowry harassment from her mother-in-law and her in-laws attacked and abused her using filthy language. Therefore, she lodged a complaint, dated 05.02.2025, but the same has not been considered. Hence this petition has been filed. 2/5
3.The learned Additional Public Prosecutor appearing for the respondent police would submit that already based on the petitioner's complaint, an FIR in Crime No.76 of 2025, dated 08.02.2025 has been registered and now the petitioner sent the representation to include other persons as accused in this case. The investigation in this case is pending and the petitioner's representation will be taken into account at the time of investigation and the respondent police will act in accordance with law.
4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondents, is inclined to pass order.
5.Since the learned Additional Public Prosecutor assured to consider the petitioner's representation, the third respondent is directed to consider the petitioner's representation on merits and in accordance with law.
