Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) of I.P.C., in Crime No.25 of 2018, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that on 30.03.2018, while playing volley-ball, the petitioners have abused the defacto complainant by using filthy language and threatened him with dire consequences. Hence, the case has been registered for the above said offences.
3. It is submitted by the learned counsel for the petitioners is that due to previous enmity, the present complaint has been lodged as against the petitioners and that the petitioners are innocent persons and that they have not committed any offence and prays for anticipatory bail in favour of the petitioners. https://hcservices.ecourts.gov.in/hcservices/
4. It is submitted by the learned Government Advocate (Criminal side) that the victim has treated only as outpatient.
5. Considering the facts and circumstances of this case and that the victim has treated only as outpatient. Hence, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Sathankulam and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
