Kallupatti, Peraiyur Taluk, Madurai District. 1/4

ORDER

The present writ petition has been filed challenging the order passed by the second respondent wherein the petitioner has been directed to pay a sum of Rs.3,92,654/- on the ground of alleged theft of energy.

2. According to the learned Counsel appearing for the writ petitioner, without issuing any provisional assessment order or hearing the writ petitioner, such an order cannot be passed.

3. When the writ petition came up for admission today, the learned Standing Counsel appearing for the respondents brought to the notice of the Court that they have issued provisional assessment order and furnished a copy of the same to the learned Counsel appearing for the writ petitioner.

4. In view of the above said facts, the petitioner is directed to pay a sum of Rs.1,00,000/- (Rupees One Lakh only) without prejudice to his contentions. On payment of the said amount, the service connection shall be restored. 2/4

5. The petitioner shall submit her explanation to the provisional assessment order within 3 weeks from the date of receipt of a copy of this order. After considering the explanation, the respondents are directed to pass final assessment order. Till such time, balance amount shall not be demanded.
