PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st respondent to stop the unauthorized construction illegally commenced by the respondent Nos. 4th to 7th in Petitioner's Patta land in Town Survey No.3A2 and 3A1A situates at Block No.20, Town Survey Ward D, Seenivasapuram, Kodaikanal Town, Dindigul District by considering petitioners representation dated 12.02.2026 preferred to the 1st and 3rd respondents.

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present writ petition seeking a direction to the first respondent to stop the unauthorized construction illegally commenced by 2/6
respondent Nos. 4 to 7 on the petitioner's patta land comprised in Town Survey Nos. 3A2 and 3A1A, situated in Block No. 20, Town Survey Ward D, Seenivasapuram, Kodaikanal Town, Dindigul District, by considering the petitioner's representation dated 12.02.2026.
2. The learned counsel appearing for the first respondent submitted that approximately 85% of the encroachment has already been removed. Only one small shop remains. It is further submitted that a survey will be conducted to ascertain whether the said shop also falls within the survey numbers mentioned in the writ petition. If, upon such survey, it is found to be an encroachment, the same shall be removed.
3. In view of the above submission, the concerned authorities are directed to conduct a survey within a period of one month from the date of receipt of a copy of this order. If the survey reveals that the shop is an encroachment or that the construction is unauthorized, the same shall be removed within a period of one month thereafter.
