O R D E R

Seeking a direction to the respondents to transfer the investigation and file a final report as expeditiously as possible, the petitioner has come up with this petition.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents and perused the records carefully.

3. Though the petitioner's complaint was given in the year 2014, it has been registered in the year 2015 in Crime No.49 of 2015. The learned

counsel for the petitioner submitted that despite the fact that sufficient records has been given, no further investigation has been done. He also submitted that the Investigation Officer simply stated that since the case is purely civil in nature, it would be closed and also stated that the petitioner is not cooperating.

4. This court is not willing to go into the allegations or the denial. The petitioner is being the defacto complainant does not have any confidence in sixth respondent.

5. Considering the facts and circumstances of the case, and the contentions made by both sides, the fourth respondent is directed to transfer the investigation from sixth respondent to any other officer under his control and he also directed to monitor and supervise the same. After transferring the investigation, final report will have to be filed within a period of four months thereafter.

6. This criminal Original Petition is disposed of with the above direction. Consequently, connected Miscellaneous Petition is closed.
