This Criminal Original petition is filed for a direction to the respondents 1 and 2 not to harass the petitioner under the guise of enquiry.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3.The learned counsel for the petitioner submitted that one Abraham has filed a private complaint under Section 138 of Negotiable Instruments Act and that the same is pending in S.T.C.No.393 of 2016. It is further stated that the said Abraham has also given a complaint before the second respondent and based on the complaint, the second respondent is harassing the petitioner under the guise of enquiry.

4.The learned Additional Public Prosecutor, on instructions, submitted that the complaint given before the second respondent by the said Abraham was closed as the private complaint filed by him is pending. It is further stated that no further enquiry is contemplated.
