This petition has been filed to direct the Respondent to register a case based on the complaint preferred by the petitioner, dated 07.02.2018.

2.According to the petitioner, the proposed accused have forged the signature of the petitioner in a fraudulent manner and attempting to tress-pass into the petitioner's shop. Therefore, the petitioner made a complaint to the second respondent police for taking action against the proposed accused, but sofar, no action has been taken and hence, the petitioner has filed the present Criminal Original Petition.

3.The learned Additional Public Prosecutor would submit that the proposed accused have filed a suit in O.S.No.295 of 2017, on the file of the District Munsif, Melur for permanent injunction and at this stage, the prayer sought for in the criminal original petition cannot be granted by this Court.

4.Considering the aforesaid submission, this Criminal Original Petition is dismissed. It is left open to the petitioner, if necessary, he can file a fresh complaint to the respondent police at later stage.
