ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Section 8(c) r/w 20(b) (II) (B) and 25 of NDPS Act., in Crime No.60 of 2018, seeks anticipatory bail.

2.The case of the respondent is that a bag contained about 4 Kg and 850 gms of Ganja was recovered from the Car driven by the petitioner.

3.This Court went through the contents of the F.I.R. They do not inspire the confidence of this court. At the same time the fact remains that the contraband involved is a small quantity. It is true that Section 37 of the NDPS Act will not apply in this case. There are several suspicious features obtaining in this case. The petitioner admitted that he has driven the Mercedes Benz Car. 4.Even though this Court taking into account the circumstances obtaining in this case, this Court is inclined to grant anticipatory bail, considering the fact that it is an offence arising under NDPS Act, this Court is of the view that the petitioner should surrender before the Jurisdictional Special Court and apply for regular bail and on such application is being filed, https://hcservices.ecourts.gov.in/hcservices/

the Jurisdiction Special Judge shall consider the same on the same day.
