For Respondent : Mr.S.Chandarasekar, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- for Bail in Crime No.121 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State. 2.The petitioner is arrayed as accused No.1. He was arrested and remanded to judicial custody on 04.12.2019, for the offences punishable under Sections 449, 394, 398, 302 of I.P.C. @ 449, 457, 394, 398, 302, 326 and 307 of IPC, in Crime No.121 of 2019, on the file of the respondent police. He seeks bail. 3.The petitioner herein was arrested for murdering Poojari in the temple, who resisted him and his associate the juvenile, while robbing the temple Hundi. Eye-witness of the de-facto complainant has given description of the accused and later, this accused and his associate have been arrested. The incident took place in a remote forest area on 03.05.2019. This petitioner was apprehended by the respondent police on 04.12.2019.

CRL OP(MD). No.4292 of 2020 4.The learned Additional Public Prosecutor appearing for the State would submit that the investigation is completed and final report has been filed in P.R.C.No.4 of 2020, before the learned Judicial Magistrate, Uthamapalayam. It appears that the petitioner who belongs to the same locality, after knowing about the collection in the Hundi, had broken the Hundi to loot it. The deceased person who resisted, has sustained multiple injury at the hands of the accused and died.

5.Considering the nature of the offence and the stage of the case, this Court is not inclined to entertain the bail petition.
