ORDER : The Court Made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 IPC in Crime No.8 of 2015, seeks anticipatory bail. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent Police.

3.The petitioner and his wife was allegedly running the chit fund and the total due amount is said to be around Rs.10 lakhs. The case against the petitioner rests on the documentary evidence. Hence, the arrest of the petitioner will not serve any purpose, but the petitioner has to be put on terms.

4.The learned senior counsel appearing for the petitioner undertakes on his behalf that a sum of Rs.1,00,000/- will be credited to the Crime No.8 of 2015 before the Jurisdictional Special Court. The said amount will be disbursed based on the outcome of the criminal case.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Chief Judicial Magistrate, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
