ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.3 and 7 were arrested and remanded to judicial custody on 25.03.2015 for the alleged offences punishable under Sections 147, 342, 302 and 201 IPC in Crime No.27 of 2015 on the file of the respondent police and hence, seek bail.
2.The case of the prosecution is that the deceased, who was an Ex.employee of the first accused had misunderstanding with him and due which, the accused have attacked and caused his death. 3.The learned counsel for the petitioners submitted that originally a complaint was given on 16.03.2015 and the same was registered as man missing and thereafter, the case was altered to 302 IPC and other offences on 19.03.2015 and these petitioners were subsequently implicated in this case. He would further submit that the similarly placed accused Nos.1 and 4 were granted bail by this Court in Crl.O.P.(MD)Nos.9391 & 9293 of 2015 on 27.05.2015 and the https://hcservices.ecourts.gov.in/hcservices/
accused Nos.11 and 12 were granted bail by the Sessions Court, Karur in Crl.M.P.Nos.573 & 574 of 2015 on 01.06.2015. He would further submit that the entire investigation is over and the applications for anticipatory bail can be considered liberally.
4. Per contra, the learned Government Advocate (crl. side) appearing for the respondent police submitted that due to previous enmity between the first accused and the deceased, all the accused indiscriminately attacked the deceased, which let to death. He would further submit that the accused No.3 attacked the deceased with wooden log and the accused No.7 had used stick and belt for attacking the deceased. He would also submit that the major part of the investigation is over.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Karur and on further condition that the petitioners shall appear before the respondent police daily twice at 10.00 a.m. and 5.30 p.m. until further orders.
