ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 05.12.2025 for the offences punishable under Sections 4(2), 5(f), 6 of POCSO Act and 351 (2) of BNS Act, 2023, in Crime No.07 of 2025 on the file of the respondent police, seeks bail.

2. The prosecution case is that the petitioner had sexually assaulted the victim on several occasions and that, on 30.12.2025 at about 08.30 p.m., the petitioner entered the victim's residence and committed penetrative sexual assault. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 05.12.2025. Hence, he seeks bail to the petitioner.

4. The learned Government Advocate (Crl. side) submitted that the 2/4

petitioner committed penetrative sexual assault on the victim. Therefore, he opposed for grant of bail to the petitioner.

5. The petitioner is 29 years old and is working as a teacher in the school where the victim is studying in IX Standard. Being a teacher, the petitioner ought to have protected the students, but instead has indulged in such a heinous crime. Considering the heinous nature of the offence, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. (S S Y J) 20.02.2026 jbr TO
