This Civil Miscellaneous Petition has been filed to condone the delay of 65 days in preferring the review petitions in Rev.Aplc.(MD) SR. No. 15546 of 2025 against the order of this Court in W.A.(MD).No.305 of 2024 dated 26.03.2024.
The affidavit filed in support of this condone delay petition states due to a communication gap between the petitioner and his counsel, there was a delay of 65 days in filing this review application.
The present review application is filed against the order of this Court in W.A.(MD).No.305 of 2024 dated 26.03.2024. The writ petitioner while preferring the writ appeal had stated that the facts of his case is different from the facts of other writ petitioners. The facts of the writ petition pertains to irregularity in appointments made in various posts in the second respondent Union/ board. The learned Single Judge as well as the Division Bench of this Court, after perusing the records and more particularly, the enquiry report had found that the purity and sanctity of the selection process have been compromised to a larger extent and appointments were made by violating the established procedures, therefore, held that the appointments made need to be set aside.
This Court also on revisiting the facts found that the purity and sanctity of the selection process have been compromised to a larger extent and the case of the petitioner is no different from the other petitioner to be de-linked and heard again by way of review petition, the fraud in the selection process are so intrinsically intertwined making impossible to isolate genuine appointments. Hence the selection has to go in toto. 5.
For the above said reason, the Rev.Aplc(MD). No.24 of 2025
filed by one K. Anbarasi was dismissed by this Court. Since, the case of this petitioner is also identical and similar to the Rev.Aplc(MD).No.24 of 2025, no purpose will serve in condoning the delay of 65 days in preferring the review petition. Hence, this Civil Miscellaneous Petition and the review application in Rev.Aplc(MD).SR.No.15546 of 2025 dismissed. There shall be no order as to costs.
