ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A2 in Crime No.289 of 2015 on the file of the respondent police, were arrested and remanded to judicial custody on 05.03.2015 for the alleged offences punishable under Sections 397 r/w. 392 and 506(ii) of I.P.C., and hence, seek bail. 2.The case of the prosecution is that the de-facto complainant gave her ear ring of half sovereign to the petitioners for polishing and thereafter, the petitioners ran away from the scene of occurrence with gold ear ring.

3.The learned counsel for the petitioner submitted that the petitioners are belonging to the state of Bihar and they are doing business of purchasing old silk sarees from the public and after removing silver jarigai from the border and they melt silver jarigai and they sell it in open market. He further submitted that the petitioners are innocent persons and they have been falsely implicated in this case. 4.The learned Government Advocate (Crl.side) would submit that the petitioners are having six previous cases and of the petitioners are released on bail, they will abscond and hence, he vehemently oppose this application.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioners are having six previous cases and the petitioners are released on bail they will abscond, this Court is not inclined to grant bail to the petitioners. Hence, this criminal original petition is dismissed.
