ORDER
This Writ Petition has been filed seeking a direction to the third respondent to consider the petitioner's representation dated 13.08.2019 and to make an entry in the Revenue Records as 6 cents of lands as common pathway in Survey No.3/1, situated at Pappapatti Village, Natham Taluk, Dindigul District.
2.The petitioner made a representation dated 13.08.2019 to the respondents to survey and make an entry in the Revenue Records as 6 cents of lands as common pathway in Survey No.3/1, situated at Pappapatti Village, Natham Taluk, Dindigul District. But, no action has been taken on the petitioner's representation so far. Hence, the present Writ Petition.
3.Today when the matter is taken up for hearing, Mr.R.Sethuraman, learned Special Government Pleader appearing for the respondents, has produced a proceeding of the third https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.5020 of 2020 respondent/Tahsildar, Natham, dated 20.07.2020 and submitted that in the revenue records, the land in question stands as S.No.3/8 instead of S.No.3/1 and the Patta in respect of the said land stands in the name one Jeganathan, S/o.Ganesan. Further, the mother of the said Jeganathan has objected to survey the said land. In view of the objection raised by her, the third respondent/Tahsildar, Natham, is not in a position to conduct survey of the said property as requested by the petitioner. Therefore, the petitioner has to seek appropriate remedy before the concerned forum by questioning the Patta granted in favour of the above said Jeganathan. 4.
Recording the above said submission made by the learned Special Government Pleader appearing for the respondents, this Writ Petition stands dismissed with liberty to the petitioner to work out her remedy before the appropriate forum.
