ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.4, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 399 and 402 IPC, in Crime No.360 of 2016, on the file of the respondent police and hence, seeks anticipatory bail. 2.
The case of the prosecution is that on 26.06.2016, while the respondent police was patrolling, the petitioner and other accused were making preparation to commit theft. On seeing the police party, the petitioner ran away from the scene of occurrence. The respondent police arrested the other accused. On complaint, case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Due to recent preventive measure only, the petitioner has been falsely implicated in this case. 4.The learned Government Advocate (Criminal side) submitted that the petitioner along with other accused persons planned to commit theft and on seeing the police party, the petitioner ran away from the place of occurrence. The other accused were already arrested and they are still in judicial custody. The petitioner is having 10 previous cases. Investigation is pending. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the serious nature of allegation levelled against the petitioner and other accused are still in judicial custody, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly this petition is dismissed.
