ORDER : The Court Made the following order :- The petitioner/sole accused, in Cr.No.188 of 2015 on the file of the respondent police, arrested on 06.03.2015, for the alleged commission of offences under Sections 366(A), 376, 506(i) of I.P.C r/w 3(2)(v) of SC/ST (PA) Act, seeks bail.
2. The case of the prosecution is that on 03.03.2015, the petitioner had kidnapped the daughter of the defacto complainant and committed rape.
3. The learned counsel for the petitioner submitted that the petitioner and the defacto complainant had fallen in love with each other and due to enmity, a false complaint has been given implicating this petitioner in this case. He further submitted that the alleged occurrence is said to have taken place on 03.03.2015 and the girl was recovered on 06.03.2015 and till then, she was comfortably with the petitioner.
4.The learned Government Advocate (Crl.side) submitted that the victim is aged about 17 years and she has love affair with the accused and the major part of the investigation is over. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the fact that the petitioner and the defacto complainant had fallen in love with each other, this Court is inclined
to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, No.III, Madurai, and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m until further orders.
