PRAYER: The Criminal Original Petition has been filed under Section 482 of the Criminal Procedure Code, to call for the records pertaining to the proceedings in C.C.No.53 of 2015 on the file of the Judicial Magistrate, Palani and quash the same as illegal.

O R D E R

The Criminal Original Petition has been filed to call for the records pertaining to the proceedings in C.C.No.53 of 2015 on the file of the learned Judicial Magistrate, Palani and quash the same as illegal.

2.Though the learned counsel for the petitioners has raised several grounds for quashing the proceedings in C.C.No.53 of 2015, he submitted that it would suffice, if a direction is issued to the trial Court to complete the trial within a time limit that may be stipulated by this Court and also to permit the petitioners to raise all the grounds raised in this petition before the trial Court.

3.In the light of the above submission, this Court without going into the merits of the case, directs the learned Judicial Magistrate, Palani to complete the trial in C.C.No.53 of 2015 within a period of six months from the date of receipt of a copy of this order. The appearance of the second petitioner, since he is aged about 68 years, before the trial Court is dispensed with except the dates on which the learned Judicial Magistrate insists upon the second petitioner to appear before the Court. 4.With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed.
