ORDER : The Court Made the following order :- The petitioner, who is arrayed as the first accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 427 and 506(ii) IPC in Crime No.198 of 2005 and hence, seeks anticipatory bail.

2. It is submitted by the learned counsel for the petitioner that after completion of investigation charge sheet was filed and the same was taken on file in C.C.No.92 of 2006 and the petitioner is regularly appearing in this case and due to viral fever, he did not appear before the court on 09.01.2015 and hence, Non Bailable Warrant was issued. The learned counsel undertakes that the petitioner would appear before the court for all future hearings.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and also perused the entire materials available on record.

4. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest https://hcservices.ecourts.gov.in/hcservices/ or on his appearance before the learned Judicial Magistrate, Theni, Theni District, and on executing a bond for a sum of Rs.10,000/- (Rupees

ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial court for all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5.
