O R D E R

The present writ petition has been filed seeking a mandamus directing the first respondent to issue the petitioner's passport based upon his application dated 24.02.2026.

The learned Government Advocate (Criminal Side) appearing for respondents 2 to 4 submitted that the petitioner has been implicated in Crime No.3 of 2022 on the file of the fourth respondent, which has culminated in the filing of a charge sheet before the learned Judicial Magistrate Court No.I, Tirunelveli, in P.R.C.No.5 of 2024 on 05.01.2024. So far, the case has not been committed.

3. The learned Government Advocate (Criminal Side) further submitted that the petitioner has also been implicated in another criminal case in Crime No.221 of 2022 on the file of the second respondent, which is still under investigation and in which no charge sheet has been laid so far.

4. Considering the fact that no cognizance has been taken against the petitioner as on date, there is no legal impediment for the first respondent to consider the petitioner's request for issuance of passport. Therefore, the first respondent is directed to consider the petitioner's application and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

5. With the above observations, this writ petition stands disposed of. No costs.
