ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A6 in Crime No.104 of 2015 on the file of the respondent police, were arrested and remanded to judicial custody on 05.04.2015 for the alleged offences punishable under Sections 399 of I.P.C., and 25(1)(a) of Arms Act and hence, seek bail.

2.The case of the prosecution is that the petitioners along with others assembled near Srivaikundam Tamirabarani river bridge and making preparation to commit dacoity and also found in possession of Aruval.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated. He further submitted that the co-accused were already released on bail.

4.The learned Government Advocate (Crl.side) would submit that A1 is having one previous case for the alleged offence under Sections 323, 324 and 506(ii) of I.P.C., and A6 is having four previous cases for the alleged offences under Sections 379, 323, 324 and 506(ii) of I.P.C., and TNPPDL Act.

5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Srivaikundam and on further condition that the petitioners shall stay at Trichy and report before the Trichy Cantonment Police Station daily at 10.00 a.m and 05.00 p.m., until further orders. sd/- 22/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
