Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2, apprehends arrest in Crime No.291 of 2014 on the file of the respondent Police for the alleged offences punishable under Sections 420 IPC and hence, seeks anticipatory bail.

2.The case of the prosecution is that the accused were running a chit company and they have failed to return the amount of Rs.3,50,000/- to their subscribers.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the first accused was arrested and released on bail. The learned counsel for the petitioner undertakes to deposit a sum of Rs.1,50,000/- to the credit of Crime No.291 of 2015. 4.The learned Government Advocate (Crl.side) appearing for the respondent Police submitted that investigation is almost over and the first accused was arrested and released on bail. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Aruppukottai, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required. Further, the petitioner shall deposit Rs.50,000/- (rupees fifty thousand only) to the credit of Crime No. 294 of 2014 within a period of two weeks from the date of receipt of a copy of this order and Rs.1,00,000/- (rupees one lakh only) within 4 weeks therefrom. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
