ORDER
This Criminal Original Petition has been filed to direct the first respondent to instruct the third respondent to not to harass the petitioner under the guise of enquiry based on the petitioner's representation, dated 21.02.2025.
2. According to the petitioner, there is a money dispute pending between the parties by mortgaging the properties. Thereby, the fourth respondent lodged a complaint against the petitioner. Taking advantage of the same, the third respondent used to harass the petitioner. Therefore, the petitioner sent a representation, dated 21.02.2025 not to harass the petitioner and the same has not been considered. Hence, the petition.
3. The learned Government Advocate (Crl. Side) appearing for the official respondents would submit that there is a money dispute pending between the petitioner and the fourth respondent. Thereby, the fourth respondent lodged a complaint before the third respondent. Based on the 2/5
complaint, they called the petitioner for enquiry. But the petitioner without appearing for enquiry filed this petition. However, they will consider and dispose of the representation of the petitioner, dated 21.02.2025 within a week along with the fourth respondent's complaint.
4. Considering the limited scope of prayer sought for in this petition, this Court without even issuing notice to the fourth respondent inclined to dispose this petition.
5. In this case, the prayer of the petitioner is not to harass the petitioner. According to the third respondent, based on the complaint given by the fourth respondent as against the petitioner, they called the petitioner for enquiry purpose. Apart from that, no any harassment was made by them as alleged by the petitioner. Since the third respondent called the petitioner for enquiry purpose, it is for the third respondent to conduct enquiry and dispose of the same, within a period of one (1) week from the date of this order. 3/5
6. With the above said directions, this Criminal Original Petition stands disposed of.
