ORDER

This writ petition has been filed for a mandamus directing the 1st respondent to cancel the Town Survey Register to the land in New T.S.No. 19, Old S.No. 21/4, Block - 12 to the extent of 4.36 Ares (10.78 cents) issued in the name of 2nd respondents deceased father S.R.Ganapathy dated 16.10.2018 as devoid on merits.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 and 3.

3. The learned counsel for the petitioner would submit that in the Town Survey register, the 2nd respondent's name was wrongly entered. He would also submit that the 2nd respondent's father had filed a suit for declaration. However, when all the title deeds are in the name of the petitioner, the name of the 2nd respondent has been wrongly entered in the town survey register. Hence, in order to cancel the same, the petitioner has given a representation. Since the said representation has not been considered so far, he is before this Court.

4. The learned Additional Government Pleader would submit that the Revenue Divisional Officer is competent to make any cancellation and hence, the Revenue Divisional Officer has been suo motu impleaded.

Considering the said submission, without going into the merits or the contentions of the petitioner, in the event, the first respondent issued a wrong patta in favour of the 2nd respondent and subsequent entries were made in town survey register, the 3rd respondent is the authority to cancel the same. Therefore, the petitioner is directed to make necessary application for cancellation to the third respondent. On receipt of the said application, the third respondent is directed to pass orders, on merits and in accordance with law, after hearing all the parties, within a period of eight weeks from the date of receipt of a copy of this order.

6. The writ petition is disposed of with the above direction. No costs. Consequently connected Miscellaneous Petition is closed. 10.02.2026 NCC : Yes/No Index : Yes/No RR 3/4
