Respondent PRAYER:Criminal Original Petition filed under Section 482 Cr.P.C., praying to modify the condition imposed by the learned Sessions Judge in condition (b) directing the petitioner to report before the respondent police station daily at 10.00 a.m, for a period of one month from the date of their release in Cr.M.P.No.845 of 2015 dated 25.03.2015 in Cr.No.5 of 2015 on the file of the respondent police and pass such further or other orders as this Court deems fit and proper in the circumstances of the above case.

O R D E R

This application is filed seeking modification of the condition imposed in Cr.M.P.No.845 of 2015 by the Principal Sessions Judge, Thoothukudi.

2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) appearing for the State. 3.The petitioners are facing a case for the alleged offences punishable under Sections 294(b), 506(i), 406 and 498(A) of I.P.C and Section 4 of Tamil Nadu Prohibition of Women Harassment Act. The learned Sessions Judge while granting anticipatory bail to the petitioners directed them to appear before the respondent police daily at 10.00 a.m for a period of one month.

4.The learned counsel for the petitioners submitted that the third petitioner is residing at Chennai, the fourth petitioner is residing at Usilampatti and the fifth petitioner is residing at Vanaramapatti in Kovilpatti District and they find it very difficult to appear before the respondent police daily. petitioner is ready to appear before the respondent police to comply with the condition regularly.

5.The learned Government Advocate (Crl.side) would submit that the petitioners are complying with the condition from 06.04.2015 for more than two weeks.

6.Considering the facts and circumstances of the case and also considering the fact that the second petitioner is an aged lady and the other petitioners are residing in different places, this Court is inclined to modify the condition to the effect that the petitioners No.2 to 5 shall appear before the respondent police as and when required for interrogation and the first petitioner shall comply with the condition. With the aforesaid modification, the criminal original petition is disposed of.
