ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused nos. 1,3,4 and 5 were arrested and remanded to judicial custody on 28.04.2016 for an alleged offence punishable under Sections 147,148,341,302,506(ii) and 120 of IPC in Crime No.570 of 2016, seek bail.

2. The case of the prosecution is that on 28.04.2016 at about 8.00 am the petitioners along with other accused unlawfully assembled with deadly weapons wrongfully restrained the defacto complainant and attacked him with weapons and committed murder of the deceased. On complaint, a case has been registered against the petitioners.

3. There is no representation on behalf of the petitioners for the last hearing on 04.07.2016 and today also there is no representation on behalf of the petitioners.

4. The learned Government Advocate (Crl. Side) submitted that the petitioners 1 and 2 already detained under Act 14, by order dated 03.07.2016, passed by the Office of the District Magistrate and District Collector, Dindigul District, Dindigul. accused surrounded the deceased with Aruval and knifes and caused grievous injuries and committed murder of the deceased.

5. Considering the fact that the petitioners 1 and 2 already detained under Act 14, the petition is dismissed against the petitioners 1 and 2. Considering the serious nature of allegations against the petitioners that they chased and surrounded the deceased with Aruval and knifes and committed murder of the deceased, this Court is not inclined to enlarge the petitioners 3 and 4.
