ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Section 420 of I.P.C., in Crime No.Not known of 2018, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that there is a vacancy in the Madurai Kamaraj University and later the first petitioner introduced the defacto complainant with one Vinoth and on 02.02.2018 the defacto complainant entrusted a sum of Rs.5,50,000/-(Rupees Five Lakhs and Fifty Thousand Only) with the first petitioner and Vinoth and that the defacto complainant did not get the job. Hence, the case has been registered for the above said offence.
3. Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. Side).
4. The learned counsel appearing for the petitioners submitted that he would not press the petition in respect of the first petitioner/Alaguchamy and therefore, in respect of the first petitioner/Alaguchamy, this Criminal Original Petition is dismissed.
5. This Court is of the view that the transaction is only https://hcservices.ecourts.gov.in/hcservices/
between the defacto complainant and the first petitioner. The second petitioner wife of the first petitioner Alaguchamy has been robbed in this case. Hence, in respect of second petitioner, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the second petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate Court-I, Thirumangalam, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the second petitioner shall appear before the respondent police as and when required for interrogation. The second petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
6.The second petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
