The Criminal Original Petition is filed to call for the First Information Report dated 29.08.2017 in Crime No.42 of 2017 on the file of the first respondent police and quash the same as illegal.

After arguing at length before this Court, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition as this Court is not inclined to accept his submissions for quashing the Criminal Original Petition. Hence, he is permitted to withdraw the petition. The learned counsel appearing for the petitioner has made an endorsement to that effect.

3. In view of the same, the Criminal Original Petition is dismissed as withdrawn. However, it is open to the petitioner to

raise all his defence at the time of trial or even before filing of charge sheet. Consequently, connected Miscellaneous Petition is closed.
