Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to issue an appropriate direction to the respondents 1 and 2 to take immediate action on the basis of the complaint which given by the petitioner dated 24.05.2019.

O R D E R

This Writ Petition has been filed seeking for a direction to the respondents to take immediate action on the basis of the complaint given by the petitioner dated 24.05.2019.

2. By consent of both parties, the main Writ Petition is taken up for final disposal at the stage of admission itself.

3. Mr.K.Suyambulinga Bharathi, learned Government Advocate (Crl. side) takes notice for the respondents.

4. The grievance of the petitioner is that the petitioner is the lawful owner of the property in Survey No.263 / 14 in Vadipatti Taluk, Nachikulam Village, Madurai District. The petitioner has permitted one Malarvizhi to occupy the house. Now, she is refusing to vacate the house. In the above circumstances, a complaint has been given before the first respondent on 24.05.2019 to take action against her. Since no action has been taken by the respondent Police, the petitioner has filed the present Writ Petition. https://hcservices.ecourts.gov.in/hcservices/

On a perusal of the complaint, it is seen that the petitioner has permitted one Malarvizhi to occupy her house and she refused to vacate the house, hence the complaint has been filed to take action against her. It is only a dispute between a landlord and his tenant and the Police cannot interfere in the civil dispute. In the said circumstances, this Court cannot direct the Police to take any action on the complaint. Hence, I find no merit in the Writ Petition.

6. Accordingly, the Writ Petition stands dismissed. No costs.
