ORDER : The Court Made the following order :- The petitioner, who is arrayed as the first accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 324 and 506(ii) IPC in Crime No.213 of 2015 and hence, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and other two accused abused the defacto complainant with filthy language and also threatened him with dire consequences and the petitioner and other accused caused injury by hitting stone on the defacto complainant.
3. The learned counsel for the petitioner submitted that there is a civil dispute exists between the petitioner and the defacto complainant for which they have been repeatedly filing cases against the petitioner.
4.The learned Government Advocate(Crl.side) submitted that six previous cases are pending against the petitioner.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and also perused the entire materials available on record.
6. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Eraniel, and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall https://hcservices.ecourts.gov.in/hcservices/
appear before the respondent police daily twice at 10.00 a.m and 05.00 p.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
7.
