O R D E R

(Order of the Court was made by C.V.KARTHIKEYAN,J.) We have heard the learned Additional Government Pleader appearing for the review applicants and the learned counsel appearing for the first respondent.

2. The review application arises out of an order dated 05.08.2024 in W.A(MD)No.897 of 2018.

3. W.A(MD)No.897 of 2018 was filed challenging the order dated 25.10.2016 in W.P.(MD)No.14842 of 2013. That writ petition had been filed challenging the order of the third respondent / The Senior Accounts Officer / Pen 26 in the office of the Principal Accountant General, Channai, whereby, the writ petitioner had requested the minimum pension in the post of Village Administrative Officer. The said request of the writ petitioner was rejected. The writ petition was allowed 2/5

by the learned Single Judge. In the appeal, examination had been done about the G.O.Ms.No.148, Revenue Department, dated 20.04.2011 by which, the Government had extended the benefit of minimum pension to all Village Administrative Officers, not only to those who had approached the Court but also to those who were bystanders and were watching the Court proceedings. This was irrespective of the period of service which they discharged as Village Administrative Officer. Though the name of the writ petitioner was not found in G.O.Ms.No.148 Revenue Department, dated 20.04.2011, he is eligible to avail the benefit under the said Government Order, the writ appeal was dismissed.

4. It is an admitted fact that as G.O.Ms.No.148, Revenue Department, dated 20.04.2011, applied to Village Administrative Officer and granted benefit of minimum pension. The only issue is whether it could be extended to only those who had approached the Court or not. But at any rate, the Government Order proceeds on the basis that it would be applicable to all the Village Administrative Officers and that they would get the benefit of minimum pension. Insofar as the first respondent/writ petitioner is concerned, we are further informed that the Government had also passed G.O.(Ms)484, Revenue and Disaster 3/5

Management [Ser.8(2)] Department, dated 18.07.2025 by which, the benefit of such minimum pension had been extended to the first respondent herein subject to the orders to be passed in the review application. The Government therefore, taken a conscious decision to extend the benefit. We do not find any error aparent on the face of the records in the Division Bench order.

Accordingly, the Review Application is dismissed and a direction is issued to the appellants to proceed further within a period of four weeks from the date of receipt of this order to confirm the grant of benefit of minimum pension to the first respondent/writ petitioner.
