Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who is arrayed as accused No.2 apprehends arrested at the hands of the respondent Police for the alleged offences punishable under Sections 8(c) r/w.20(b) (ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.280 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that based on the secret information, on 20.04.2016, the respondent Police conducted search at 9.30 pm and found that the petitioner and her sister viz., Shanthi were standing near Ayyampatti Thevar Street Savadi, Srivilliputur, and on seeing the Police party the petitioner has escaped and the first accused was surrounded by Police party and she was found in possession of 1 kilo 100 grams of Ganja kept in Polythene bag and after having taken for samples, A1 was arrested and remanded to judicial custody.

3. The case of the petitioner is that the petitioner is innocent and she has not committed any offence as alleged by the prosecution and her name has been falsely implicated in this case. 4.The learned Government Advocate(Crl.side) submitted that the petitioner is having two previous cases and on seeing the Police, petitioner / A2 escaped from the place of occurrence and her sister viz., Shanthi / A1 was arrested and remanded to judicial custody and the investigation of the case is pending. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the serious nature of allegations levelled against the petitioner and that the petitioner is having two previous cases in the similar offences, this Court is not inclined to grant anticipatory bail to the petitioner.
