ORDER : The Court Made the following order :- The petitioner, who is the sole accused, in Cr.No.328 of 2014 on the file of the respondent police, arrested on 30.01.2015, for the alleged commission of offences under Sections 408 and 420 of I.P.C, seeks bail.
2. The case of the prosecution is that the petitioner was working as a Manager in a Car Company and he misappropriated a sum of Rs.17 lakhs.
3. The learned counsel for the petitioner submitted that the petitioner was arrested on 30.01.2015 and he has been in judicial custody for more than 80 days and the respondent has not filed charge-sheet in this case and therefore, he is entitled for bail under Section 167(2) of the Code of Criminal Procedure. He further submitted that the petitioner is innocent and he has been falsely implicated in this case by the Car Company.
4.The learned Government Advocate (Crl.side) submitted that the the respondent completed the investigation and they are going to file charge-sheet in this case.
5.Considering the above facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, No.II, https://hcservices.ecourts.gov.in/hcservices/
Trichirappalli, and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m until further orders.
