ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 379 and 506(ii) IPC in Crime No.327 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any of the offences as alleged by the prosecution.

3. The learned Government Advocate (Crl.side) appearing for the State submitted that there is no previous case registered against the petitioner.

4. This Court has went through the First Information Report and no allegation is attributed against the petitioner. The fact remains that earlier two attempts made by the petitioner claiming relief at the hands of the court ended in vain. In the earlier order of dismissal dated 20.02.2018, as rightly pointed out by the learned Senior Counsel for the petitioner, there appears to be no basis for making such observation.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court, Valliyoor, Tirunelveli District, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
